Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Houghton For Rent (“Houghton,” “we,” “us”) for your use of Houghton Extra Credit, including the website, app, and related features (the “Service”). By creating an account or using the Service, you agree to these Terms.

Extra Credit is a promotional program operated by Houghton. It is not a separate company, and using it does not change your lease or create a tenancy.

1. Who this is for

You must be at least 18 years old (or the age of majority where you live, if older) to use the Service. Some features, including certain rewards, are limited to current Houghton tenants. Houghton may ask you to confirm eligibility and may deny, suspend, or reclaim access or benefits if you are not eligible.

2. Your account

You are responsible for the information you provide (including email, name, and phone number) and for activity on your account. Keep your login codes and device access to yourself. Tell Houghton if you think someone else used your account.

Houghton may refuse, suspend, or close accounts, including for suspected fraud, abuse, ineligibility, or violation of these Terms.

3. Entries, events, and the gameshow

Extra Credit lets you collect entries (for example by scanning Houghton QR codes) and may include a gameshow, drawing, or similar promotion. Entries have no cash value, are not property, and cannot be sold, transferred, or redeemed except as Houghton allows.

• Winning is not guaranteed. Odds depend on the number of eligible entries and the rules of that promotion.
• Houghton may change, pause, or cancel promotions, entry methods, prize lists, dates, and eligibility at any time, to the extent allowed by law.
• The Service is a promotional program, not gambling, a lottery you pay to enter, or an investment. No purchase is required to use Extra Credit itself; Houghton may still require an active lease or other conditions for specific rewards or prizes.
• Official rules for a particular gameshow or drawing, if posted, control over these Terms for that promotion.

Houghton is not responsible for lost, late, unreadable, or duplicate scans, device or camera failures, or entries that are not recorded because of network issues or abuse.

4. Rewards and third-party offers

Perks and rewards may be provided by Houghton or by third parties (for example partner offers). Partner terms, expiration, and availability are outside Houghton’s control. Houghton does not warrant those offers and is not liable for a partner’s products, redemption, or customer service.

5. Acceptable use

You agree not to:

• Create multiple accounts, share accounts, or scan codes in a way meant to cheat the program
• Copy, reverse engineer, or disrupt the Service, or access it by automated means except ordinary use of a web browser
• Interfere with other users, Houghton staff, or the operation of events
• Use the Service for anything unlawful

Houghton may void entries, withhold rewards, and close accounts if it reasonably believes these rules were broken.

6. Your lease and the Service

Extra Credit does not amend your lease. Rent, deposits, maintenance, and community rules stay under your rental agreement and applicable law. Houghton may use lease and resident records to check whether you are a current tenant.

7. Intellectual property

Houghton and its licensors own the Service, branding, and content. You get a limited, revocable, non-transferable right to use the Service for its intended personal, non-commercial purpose. You do not get any other license.

8. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, HOUGHTON DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Houghton does not promise uninterrupted or error-free operation, or that entries, rewards, or prizes will be available at any particular time.

9. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, HOUGHTON AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST ENTRIES, PRIZES, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

HOUGHTON’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS (US $100). Some places do not allow certain limits; in those places Houghton’s liability is limited to the maximum permitted.

10. Indemnity

You will indemnify and hold harmless Houghton and its owners, officers, employees, and agents from claims, damages, and reasonable legal fees arising from your misuse of the Service, your violation of these Terms, or your violation of someone else’s rights, except to the extent caused by Houghton’s own willful misconduct.

11. Privacy

How Houghton handles personal information is described in the Privacy Policy. Using the Service means you also agree to that policy.

12. Changes and termination

Houghton may update these Terms by posting a new version in the Service. Continued use after the effective date is acceptance. Houghton may stop offering Extra Credit at any time. You may stop using the Service at any time.

13. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Courts located in Houghton County, Michigan, will have exclusive jurisdiction, except that Houghton may seek injunctive relief anywhere.
